Civil Procedure–Rajasthan Tenancy Act, 1955–Secs. 88 & 188–Pendency of instant suit for last more than 43 years–Repeated adjournments for one reason or the other amounts to miscarriage of justice and against the concept of speedy trial–The instant case is a glaring case where the petitioners took a time of two decades to complete their evidence and defendants are seeking time to produce their evidence since last more than twenty years–Both the parties are responsible for causing the delay in disposal of the suit–No litigant has a right to abuse the procedure provided in the CPC–Directed for expeditious trial on the day-to-day basis without entertaining the unnecessary request of either side to defer the proceedings or hearing to a future date.
