Motor Vehicles Act, 1988–Sec. 147–Plea of Insurance Company that the trolley was not insured, therefore, the Insurance Company cannot be held liable for paying the compensation–Tyre of tractor got punctured and driver of tractor took the tractor to get the tyre repaired and he kept the trolley by the side of road–Motor-cycle collided with the trolley due to darkness–No stones or bushes or clothes were found on the place of the incident–No reflector or indicator on the trolly–It is a case where the accident has arisen due to use of vehicle–Tractor was insured and Insurance Company was rightly held liable for paying the compensation.
