Penal Code, 1860–Secs. 420 & 120-B–Essential Commodities Act, 1955–Secs. 3 & 7–Prosecution for the offences–Permissibility–Seizure of hydrocarbon mixture from the tanker–FIR was lodged on 14.12.2021 and charge-sheet was filed on 11.02.2022–Expert’s report in regard to the nature of liquid found in the tanker, has not been produced till today–Nothing on record to show that the mixture was neither diesel nor petrol but a mixture of hydrocarbons–Even, the report has not been produced after the notice issued by this Court and the period of seven months has been lapsed–Adverse inference can be drawn against the respondent–Charge-sheet is liable to be quashed.
