Penal Code, 1860–Secs. 302/34, 307/34 & 323–Conviction–Proper section–15 persons were charge-sheeted, out of them, three were acquitted by the trial Court and seven were convicted and they were given the benefit of probation–Some dispute was existed for stealing the prasad–Different versions of eye-witnesses–As per the testimony of witnesses, accused U hit the first injury on the head–Accused N, L, K & S were not attributed to be caused the head injury–Appellant N is liable to be convicted u/ss. 323 & 324/34–L gave the gandasi blow, therefore, his conviction u/s. 307/34 is liable to be confirmed–Conviction of appellant U u/s. 302/34 sustained.
