Code of Criminal Procedure, 1973–Secs. 156(3), 200 & 202–Magistrate decided to proceed himself instead of forwarding the complaint u/s. 156(3)–Appellant sought the production of DVRs containing the audio-video recording–These were declined to hand-over despite the attempt made by the institute–It is the case wherein the documentary or other evidence is in the physical possession of the accused or other individual which the police would be best placed to the police investigation–Impugned order set aside and directed for investigation by police.
