Penal Code, 1860–Secs. 392–Establishment of Offence–Prosecution was required to prove the person from whom the amount which was having to have looted–Thereafter, it was required to establish that the amount recovered from the accused is the very amount which the complainant / the person from whom the amount is looted–Prosecution failed to prove that the complainant and deceased were carrying the amount of Rs. Five lakhs cash in the dicky of scooter–Offence is not established.
