Code of Criminal Procedure, 1973–Secs. 464–Penal Code, 1860–Sec. 302/149–At the time of framing the charge, the trial Court specifically observed that the accused did commit the murder by knowingly and intentionally causing death and thereby, committed the offence u/s. 302–He was also charged u/s. 148–Ingredients of offence u/s. 302/149 & 148 were specifically brought to his notice–It cannot be said that it is a case of a defective framing of charge by not framing the charge u/s. 149.
