Penal Code, 1860–Secs. 302/120-B/34–Circumstantial evidence–Establishment–Though the post-mortem report discloses that the victim was sexually assaulted yet the FSL report does not establish any connection of the accused with the sexual assault on the deceased–Dead body was found lying in the open field–It is not clear that when the present appellants were arrested and how and in what manner their disclosure statement led to the recovery of the dead body–Circumstances are neither conclusive in nature nor form a cogent and consistent chain so as to exclude every other hypothesis except the guilt of the appellants–Conviction is liable to be set aside.
