Code of Criminal Procedure, 1973–Sec. 228–Scope–Once this Court had remanded the case for reconsideration to pass a fresh order on charge after giving the opportunity of hearing, it was expected from trial Court to have referred to the evidence available on record before directing for framing of charge against the accused.
