Hindu Marriage Act, 1955–Secs. 13 & 24–Divorce proceedings were concluded on 15.01.2018 whereby the prayer for resolution of marriage was rejected and a decree for judicial separation was passed–Execution proceedings seeking to execute the order for interim maintenance order after 15.01.2018–Objection as regard to the maintainability of petition–Rejection of objection application with the view that appeal against the order dated 15.01.2018 is pending and same is in continuation of the suit–Whether justified ?–Held, no–Order of interim maintenance could only remain in force during the pendency of proceedings u/s. 13 of the Act before the Trial Court–Impugned order set aside–Respondent is free to file the application u/s. 24 during the pendency of the appeal.
