Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 35–Once the possession of the contraband by the accused is established, it is for him to discharge the onus of proof that he was not in conscious possession–Burden can be discharged through different modes–Accused can rely on the material available in the prosecution case raising doubts in the prosecution case–He may also adduce other evidence–Further, if the circumstances appearing in the prosecution case give reasonable assurance to the Court that the accused
could not have had the knowledge of the required intention, the burden cast on him would stand discharged even if he had not adduced any other evidence of his own.
