Code of Civil Procedure, 1908–Secs. 35A & 151–Direction of Court to file an undertaking that the appellant will pay a sum directed by the Court to the defendant as damages if he fails in the suit–Propriety of–Such direction cannot be issued by civil Court–Suit or proceedings initiated in accordance
with law cannot be considered as an abuse of Court merely on the ground of causing hardship–Specific provisions are there for costs, security and damages–Court can invoke the inherent jurisdiction u/s. 151 on the ground that it is necessary for ends of justice.
