Penal Code, 1860–Sec. 34–Vicarious liability under the Section–When will arise?–Held, it will arise only when the following two conditions stand fulfilled:-
(i) the mental element or the intention to commit the criminal act conjointly with another or others, and
(ii) the other is the actual participation in one form or the other in the commission of the crime.
