Penal Code, 1860–Secs. 302, 363, 366, 376(2)(g) & 377–Protection of children from Sexual Offences Act, 2012–Secs. 4, 5 & 6–Completion of trial within a period of seven days–Amicus curiae was called on the day of framing charge–He was not having sufficient time to go through even the basic documents nor advantage to any discussion or interaction with the accused, and time to reflect over the matter–Trial Court was to adjourn the matter for some time–Further, the accused was examined u/s. 313 before the complete evidence laid by the prosecution and receiving the FSL and DNA report–Judgment of conviction deserves to be set aside with the direction of denovo consideration.
