They could not be subjected to criminal process–Ingredients of offence are found absent–Further, merely because the petitioner N participated in the global tender and the project was awarded to his firm, it cannot bring in the purview of offence u/ss. 420, 406 & 120-B–Proceedings are liable to be quashed.
