Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8/15(c) r/w. 25–Code of Criminal Procedure, 1973–Sec. 397/401–Revision against the order of framing charge–Plea of petitioner that charge u/s. 8/15(c) could not be framed as the police filed challan u/s. 8/25–Plea is misplaced because the trial Judge is empowered to independently apply his mind to the charge sheet and to frame the charge separate from the offence for which the petitioner was charge sheeted by police–Further, the petitioner was charged with the aid of Sec. 25 which shows that he knowingly permitted his conveyance to be used for commission of any other offence punishable under the provisions of Act–No case is made out for interference.
