Negotiable Instruments Act, 1881–Sec. 138 & 145(1)–Whether the evidence of witnesses of the complainant is permissible on the affidavit ?–Held, yes–Once the complainant is permitted to lead his own evidence on affidavit, it does not stand to reason that the evidence of any other witnesses whom the complainant may wish to call, should only be led by requiring the witness to personally appear in Court to make his statements on solemn affirmation.
