Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989–Secs. 14 & 20 (As amended from 26.01.2016)–Order of taking cognizance by the Magistrate for the offence u/s. 3(1)(x) of the Act–Act is a special law and provides that a Special Court or an Exclusive Special Court to be the Court having the power to directly take the cognizance of the offence under the Act–Provisions of general law empowering the Magistrate to take cognizance of offence would be over-ridden by the Special Statute–Impugned order passed by Magistrate is without jurisdiction and cannot be sustained.
