Compensation for damage due to negligence–Deceased was admitted as an indoor patient because of high fever and delirious condition–He was found lying dead on the ground floor of the oncology gallery–Burden to prove that there was no negligence, was on defendant–He was under obligation to keep necessary vigil in the hospital premises to ensure the safety of the patient–Principle of res ipsa loquitur was rightly applied–Further, the amount of Rs. eleven lakh awarded by High Court is also just and proper–Interference declined.
