Penal Code, 1860–Secs. 302/34 & 342–Conviction–Sustainability–All the eye witnesses including the first informant are the cooked up witnesses and they are wholly unreliable–Endeavour was to false implicate the appellants
because the dead body was recovered near by their houses and drag marks were visible on the passage dividing these houses–FIR is a fabricated document as the first informant was not present in village at the time of incident–Only evidence of recoveries does not constitute the proof beyond all manners of doubts–Appellants are entitled to get the benefit of doubt.
