Motor Vehicles Act, 1988–Sec. 173–Code of Civil Procedure, 1908–Sec. 96–Appeal u/s. 173 is essentially in the nature of first appeal alike Sec. 96 of the Code–High Court is equally under obligation to decide all issues arising in the case both on facts and law after appreciating the entire evidence.
